Terms of Service

Please read these terms carefully before using AfriLink Pay. They govern your relationship with us and your use of our platform.

1. Acceptance of Terms

By accessing or using the AfriLink Pay platform, website, mobile application, or any of our APIs (collectively, the "Services"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you are using the Services on behalf of a business, company, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and all references to "you" shall mean that entity. If you do not have such authority, or if you do not agree with these Terms, you must not access or use the Services.

AfriLink Pay Ltd ("AfriLink Pay", "we", "us", or "our") reserves the right to update these Terms at any time. Continued use of the Services after such changes constitutes your acceptance of the revised Terms.

2. Services Description

AfriLink Pay provides a unified payments infrastructure platform enabling individuals and businesses to send, receive, and manage money across Africa. Our Services include, but are not limited to:

AfriLink Pay acts as a payments intermediary and technology provider. We are not a bank and do not hold deposits. Funds in transit are held in regulated float accounts with licensed partner financial institutions.

3. Eligibility

To register for and use the Services, you must meet all of the following eligibility requirements:

AfriLink Pay reserves the right to refuse, suspend, or terminate access to any user who does not meet these eligibility requirements or who provides false or misleading information.

4. Account Registration & Security

To access most Services, you must create an account. When registering, you agree to:

You are responsible for all activity that occurs under your account, whether or not you authorised it, except in cases of proven unauthorised access resulting from our negligence. AfriLink Pay will never ask for your password, PIN, or OTP via email, SMS, or phone call. Any communication claiming to be from us that requests such information should be treated as fraudulent.

We reserve the right to suspend or terminate accounts that show signs of compromise, suspicious activity, or violation of these Terms, pending investigation.

5. Payment Services

5.1 Transaction Limits

Transaction limits vary by account verification tier, originating country, destination country, and applicable regulatory requirements. Limits are displayed within the application before you confirm any transaction. AfriLink Pay may adjust limits at any time in response to regulatory changes or risk assessments.

5.2 Processing Times

We aim to process transactions within the timeframes displayed at the point of initiation. Typical processing times range from near-instant (for mobile money to mobile money transfers within the same country) to 1–3 business days (for international bank transfers). AfriLink Pay is not liable for delays caused by third-party financial institutions, network outages, or regulatory holds beyond our reasonable control.

5.3 Exchange Rates

For cross-currency transactions, the applicable exchange rate is displayed before you confirm the transaction and is locked for a short confirmation window (typically 30–120 seconds, displayed at the time of transaction). If you do not confirm within this window, the rate may be refreshed. Exchange rates include a transparent margin disclosed at the point of transaction.

5.4 Fees

AfriLink Pay charges fees for certain transactions. All applicable fees are displayed clearly before you confirm any transaction. There are no hidden fees. A general fee schedule is available on our website. Fees may vary by transaction type, currency corridor, and account tier.

5.5 Refunds and Reversals

Once a payment has been confirmed and submitted, it may not be reversible, particularly for real-time payment rails. If a transaction fails, any deducted funds will be returned to your account within 5 business days. For disputes regarding completed transactions, contact support@afrilinkpay.com.

6. Prohibited Uses

You agree not to use the Services for any of the following purposes:

Violation of these prohibitions may result in immediate account suspension, fund holds pending investigation, reporting to relevant authorities, and legal action.

7. KYC / AML Compliance

AfriLink Pay operates under licences from multiple African financial regulators and is subject to Know Your Customer (KYC) and Anti-Money Laundering (AML) obligations in every market we serve.

We will always endeavour to resolve verification requests promptly and with minimal disruption to your use of the Services. KYC requests are a legal requirement, not a choice — accounts that remain unverified above certain transaction thresholds cannot continue to transact.

8. Intellectual Property

All content, design, code, trademarks, logos, and other materials comprising or relating to the AfriLink Pay platform ("AfriLink IP") are the exclusive property of AfriLink Pay Ltd or its licensors. Nothing in these Terms transfers ownership of AfriLink IP to you.

Subject to your compliance with these Terms, AfriLink Pay grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for their intended purpose. You may not copy, modify, distribute, sell, sublicense, or create derivative works based on any AfriLink IP without our prior written consent.

If you are a developer using our APIs, your use is additionally governed by the AfriLink Pay Developer Agreement. Any feedback you provide to us about the Services may be used by us without restriction or compensation to you.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

Nothing in these Terms limits AfriLink Pay's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

10. Governing Law

These Terms shall be governed by and construed in accordance with the following laws, depending on your primary place of residence:

Both parties agree to first attempt to resolve disputes through good-faith negotiation. If unresolved after 30 days, disputes may be referred to mediation under the rules of the relevant national arbitration body before proceeding to litigation.

AfriLink Pay may modify these Terms at any time. When we make material changes, we will:
